Pennsylvania Trial Lawyer 3 Pennsylvania Trial Lawyer
Post DUI Trial Probation Questions…?

Hey everyone, I got a DUI back in April (.1 BAC + .5ng THC-9), and my trial is coming up on December 2nd. I’ve already gone to a couple AA meetings, and I’ve completed 9 counseling sessions with a county approved rehab center. Both my counselor, myself, and the guys down at AA believe that I don’t have a drug problem. My Lawyer also told me that I’ve been accepted into the ARD program.

I’m just wondering what probation is going to be like post trial with probation. Can I expect drug/alcohol testing or even work visits? I was told by someone I know that in Pennsylvania, all you have to do is call in once a week on a land line, and that was it. I have a really hectic schedule, and I want to be as prepared as possible for what ever is to come.
Thanks for the answer Jack, I really appreciate it. Also, would anyone know about the alcohol/drug testing? Would they schedule that during daytime work hours? I mean, that’s assuming I will be slated for testing etc.

It depends on how the probation office in pennsylvania supervises misdemeanor cases, and also depends on your priors. I know in my state it is written in the supervision orders that we can visit an offender at their worksite (but most PO’s rarely do this unless the offender is being shady or the offender has absconded). offenders are also subject to drug testing at any time. normally drug tests are conducted at your office visit (unless of course your PO has reason to believe that you are going to be positive for something).

In your case it is likely that you will be placed on minimum supervision or administrative supervision once you have completed all of your probation conditions.
